Apologetická interpretace mahru

Mahr je určité množství peněz, které zaplatí manžel manželce v době sňatku. Podle tvrzení apolgetů je tato platba placena z dobré vůle manžela, aby ukázal že bude schopen ji finančně podpořit během manželství. Nicméně Korán a hadísy jasně ukazují, že tohle není ten účel.

Účel mahru podle islámských textů

Vy, kteří věříte! Není vám dovoleno získávat ženy jako dědictví proti vůli jejich; neutiskujte je jen proto, abyste si mohli odnést část toho, co jste jim dříve darovali, leda že by se dopustily zjevné hanebnosti. A zacházejte s nimi podle zvyklostí uznaných! Jestliže k nim cítíte odpor, je možné, že cítíte odpor k něčemu, do čeho Bůh vložil velké dobro.

A jestliže chcete vyměnit jednu manželku za jinou a dali jste jedné z nich qintár, pak od ní neberte při rozvodu nic. Což snad byste to chtěli vzít, dopouštějíce se tak nečestnosti a hříchu zjevného?

A jak byste jí to mohli vzít, když jste byli jeden s druhým úzce svázáni a ony od vás již přijaly závazek pevný?
Vyprávěl Said bin Jubair: Zeptal jsem se Ibn 'Umara, "Co když muž podezřívá jeho manželku z nelegální soulože?" Ibn 'Umar řekl: "Prorok oddělil (rozvodem) pár z Bani Al-Ajlan a řekl: 'Aláh ví, že jeden z vás je lhář; tak bude se jeden z vás kát?' Ale oba odmítli. Poté znovu řekl: 'Aláh ví, že jeden z vás je lhář, tak bude se jeden z vás kát?' Ale oba odmítli. A tak je rozdělil rozvodem." (Aiyub dodal: 'Amr bin Dinar mi řekl: "Je zde něco v tomto vyprávění, co jsi nezmínil: 'Ten muž řekl: 'A co moje peníze (tedy mahr, který jsem dal manželce)?' Bylo řečeno: 'Nemáš právo získat zpět žádné peníze, jelikož pokud jsi mluvil pravdivě, tak jsi s ní také manželství konzumoval'; a pokud jsi lhal, tak si nezasloužíš peníze zpět.' ")

Yahya mi řekl od Malika, že slyšel, že když se zeptal jestli je povoleno muži vrátit se ke své ženě pokud se s ní neodvolatelně rozvedl a poté si ji vzal další muž a zemřel před konzumací manželství. Al-Qasim ibn Muhammad řekl: "Není to halal, aby se k ní první muž vrátil."

Malik řekl, že by nemohl zůstat v tom manželství dokud by nezaložil jiné nové manželství. 'Pokud s ní souložil v tom manželství, ona dostane věno.'

Yahya mi vyprávěl od Malika od Ibn Shihaba od Said ibn al-Musayyab a od Sulaymana ibn Yasar že Tulayha al-Asadiya byla manželkou Rushayd ath-Thaqafi. On se s ní rozvedl a ona se vdala ve své idda-lhůtě. Umar ibn al-Khattab několikrát zbil ji a jejího manžela klackem a oddělil je. Poté Umar ibn al-Khattab řekl: "Pokud se žena vdá ve své idda-lhůtě, a nový manžel nekonzumoval manželství, tak je oddělte, a když dokončí idda jejího prvního manžela, ten další je pak nápadník. Pokud konzumoval manželství, tak je oddělte. Poté musí dokončit její iddu od jejího prvního manžela a poté její iddu od druhého a nikdy nebudou znovu spojeni."

Malik dodal: Said ibn al-Musayyab řekl, že: 'měla své věno, protože on konzumoval manželství."'

Malik řekl: "Co se týče svobodné ženy jejíž manžel zemře, její idda trvá čtyři měsíce a deset dní a nevdá se pokud pochybuje o své lhůtě, dokud nepřestane pochybovat nebo pokud se bojí, že je těhotná."

Yahya mi vyprávěl od Malik že slyšel Ibn Shihaba říct, "Pokud se smrtelně nemocný muž třikrát rozvede se ženou, ona od něj dědí."

Malik řekl, "Pokud se s ní rozvede při smrtelné nemoci před konzumací manželství, ona dostane polovinu své ceny a dědictví, a nemusí dělat. 'Pokud konzumoval manželství, ona dostane celé věno' a dědictví. Panna a již předtím vdaná žena jsou zde stejné."
Ibn Umar řekl, že Aláhův posel řekl proklínačům: Vaše zúčtování je u Aláha. Jeden z vás musí být lhář. Nemáš teď právo na tuto ženu. 'On řekl: Posle Aláhovu, a co mé bohatství (věno, které jsem jí zaplatil v době svatby)? On řekl: Nemáš na něj právo. Pokud říkáš pravdu, je to odměna za to, že jsi měl právo mít s ní pohlavní styk', a pokud o ní lžeš, je to tobě pořád vzdálenější, než ona.
Vyprávěla Aiša, matka věřících: Apoštol Aláhův řekl: svatba ženy, která se vdá bez souhlasu jejího strážce je neplatná. (Řekl to) třikrát. 'Pokud spolu žili, dostane své věno za pohlavní styk, který s ní manžel měl.' Pokud je zde spor, sultán je strážcem toho, kdo žádného nemá.
Vyprávěl Jabir ibn Abdullah:

Prorok řekl: 'Pokud kdokoliv dá jako věno své manželce dvě hrsti mouky nebo datlí, tak na ni má právo.'

AbuDawud řekl: Tuto tradici vyprávěl AbdurRahman ibn Mahdi, od Salih ibn Ruman, od AbuzZubayr od Jabir jako jeho vlastní slova (ne od proroka). Zároveň to bylo přeneseno AbuAsim od Salih ibn Ruman , od AbuzZubayr od Jabir který řekl: Během života Aláhova apoštola, jsme zakládali dočasná manželství za hrst zrní.
Vyprávěla Aisha, matka veřících: Apoštol Aláhův řekl: Svatba ženy, která se vdá bez souhulasu jejího strážce je neplatná. Řekl to třikrát. Pokud spolu žili, dostane věno za sex který její manžel měl. Pokud je zde hádka, sultán je strážcem toho, kdo žádného nemá.
Vyprávěl Basrah: Muž z Ansar zvaný Basrah řekl: Vzal jsem si zahalenou pannu. Když jsem na ní šel, zjistil jsem, že je těhotná. Prorok řekl: 'Dostane věno, jelikož ti zpřístupnila svoji vagínu.' Dítě bude tvůj otrok. Poté co porodí, zbičujte ji.

Jak vidíme v hadísech výše, účelem mahru je legalizovat sexuální styk pro muže. Explicitněji řečeno, jak vidíme výše, mahr je platba za použití ženské vagíny pro sexuální styk.

Dočasné manželství vs. apologetika

Jabir b. 'Abdullah řekl: Uzavírali jsme dočasná manželství davajíc hrst mouky jako věno, během života Aláhova posla (saw) a během doby Abu Bakra dokud to 'Umar nezakázal v případě 'Amr b. Huraith.
Sabra Juhanni řekl: Aláhův posel (saw) nám povolil dočasné manželství. Tak jsem já s jedním člověkem šel ven a uviděl ženu z Bana 'Amir, která byla jako mladá dlouho-krká velbloudice. 'Nabídli jsme se jí (pro uzavření dočasného manželství), nacož ona řekla: Jaké věno mi dáte?' Řekl jsem: Svůj kabát. A můj společník také řekl: Můj kabát. A kabát mého přítele byl lepší, než ten můj, ale já jsem byl mladší, než on. Takže když se podívala na kabát mého přítele, líbil se jí a když se podívala na mě byl jsem pro ni atraktivnější. Poté řekla: Tedy, ty a tvůj kabát jsou pro mě dostatečné. Zůstal jsem s ní tři noci a poté Aláhův posel řekl: Ten, kdo má takovou ženu, že s ní uzavřel dočasné manželství, by ji měl opustit.

Účelem tohoto článku není diskutovat o tom, jestli je dočasné manželství stále povoleno nebo ne. Faktem je, že jednou povoleno bylo a otázka tedy zůstává; pokud apologetické tvrzení o účelem mahru je správné, proč byl mahr potřeba pro uzavření dočasného manželství? Jinak řečeno, pokud je mahr jen pro demonstraci mužovy schopnosti a ochoty finančně podpořit svoji manželku během manželství a nikoliv platba za sexuální vztah, tak proč v dočasném manželství za účelem krátkodobého sexuálního vztahu, je mahr vyžadován?

Rovně jiným ženám stejného společenského postavení

Přestože mahr není dán v pevně dané výši, je zřejmé, že mahr je závislý na společenském postavení ženy. Nemůže dostat menší mahr pokud je sirotek nebo stará; nebo pro jakýkoliv jiný důvod popsaný v Koránu nebo hadísy. Pokud je to svobodná žena, tak si zaslouží mahr stejné hodnoty jako jakákoliv jiná svobodná žena. Otrokyně nemají stejné společenské postavení, takže nemají nárok na mahr stejné hodnoty. Korán jasně říká, že musíte být fér při dávání mahru:

Bojíte-li se, že nebudete spravedliví k sirotkům... berte si za manželky ženy takové, které jsou vám příjemné, dvě, tři a čtyři; avšak bojíte-li se, že nebudete spravedliví, tedy si vezměte jen jednu nebo ty, jimiž vládnou pravice vaše. A tak se nejlépe vyhnete odchýlení.
Kdo z vás se nemůže pro nedostatek prostředků oženit s věřícími muhsanami, nechť vezme si z těch, jimiž vládnou vaše pravice, věřící dívky; a Bůh zná dobře vaši víru, a že patříte jeden k druhému. Ožeňte se s nimi se svolením jejich lidí a dejte jim jejich odměnu podle uznaných zvyklostí jako muhsanám, a nikoliv jako prostopášnicím nebo jako těm, jež mají milence. A když se stanou muhsanami a dopustí se potom hanebnosti, nechť jejich trestem je poloviční trest příslušející muhsanám. A to je pro ty z vás, kdož obávají se, že dopustí se prohřešku, avšak budete-li trpěliví, bude to pro vás nejlepší. A Bůh je odpouštějící, slitovný.

Mahry dané Mohamedem a jeho současníky

Vzít si otrokyni a dát jí svobodu

Vyprávěl 'Abdul 'Aziz:

Anas řekl: 'Když Aláhův apoštol napadl Khaibar, provedli jsme fadžr modlitbu brzo ráno když byla ještě tma. Prorok jel a Abu Talha jel taky a já jsem jel za Abu Talha. Prorok projel skrze cestu Khaibaru rychle a mé koleno se dotýkalo stehna proroka. Odkryl své stehno a uviděl jsem bělost prorokova stehna. Když vešel do města řekl: 'Allahu Akbar! Khaibar je zničen. Kdykoliv se přiblížíme k národu, tak budou mít zlé ráno, ti co byli varováni.' Opakoval to třikrát. Lidé opustili svoji práci a někteří řekli: 'Mohamed (přišel).' (Někteří společníci dodali: "S jeho armádou.") Dobyli jsme Khaibar, vzali zajatce, a posbírali kořist. Dihya přišel a řekl 'Ó Aláhovu proroku! Dej mi otrokyni ze zajatkyň.' Prorok řekl: 'Běž a vem si nějakou otrokyni.' Vzal si Safiya bint Huyai. Muž přišel k prorokovi a řekl: 'Ó Aláhovu apoštole! Dal jsi Safiya bint Huyai pro Dihya a ona je vůdkyně kmenů Quraiza a An-Nadir a nehodí se k nikomu jinému, než k tobě.' A tak prorok řekl: 'Přiveďte ho spolu s ní.' A tak Dihya přišel s ní a když jí prorok uviděl, řekl Dihya: 'Vem si kteroukoliv otrokyni jinou než tuhle ze zajatkyň.' Anas dodal: 'Prorok ji poté osvobodil a vzal si ji."'

Thabit se zeptal Anase, '"Ó Abu Hamza! Co jí prorok zaplatil (jako mahr)?" On řekl: "Ona sama byla její mahr, neboť on jí dal svobodu a poté si ji vzal."' Anas dodal "Zatímco byl na cestě, Um Sulaim ji oblékl pro její manželství (oslavu) a v noci ji poslal jako manželku prorokovi.

Kus zlata vážící jako datlová pecka

Vyprávěl Sa'dův otec: Když emigranti dosáhli Medíny. Aláhův apoštol zavedl svazek bratrský mezi 'Abdur-Rahman a Sad bin Ar-Rabi. Sad řekl 'Abdur-Rahman, "Jsem nejbohatší, ze všech Ansar, takže chci rozdělit svůj majetek (mezi námi), a mám dvě manželky, tak se podívej, která z nich se ti líbí a řekni mi, ať se s ní můžu rozvést, a když dokončí svoji čekací periodu ('Idda) rozvodu, tak si jí vem." Abdur-Rahman řekl: "Nechť Aláh požehná tvoji rodinu a majetek tvůj; kde je tvůj obchod?" Tak mu ukázali obchod Qainuqa'. (Šel tam a) vrátil se s výdělkem ve formě sušeného jogurtu a másla. Chodíval dále (do obchodu) až jednoho dne přišel, nesoucí stopy vůně. Prorok řekl: "Co to je?" Odpověděl: "Oženil jsem se." Prorok se zeptal: '"Kolik mahru jsi jí dal?" Odpověděl: "Dal jsem jí pecku zlata nebo kus zlata rovný váze datlové pecky."' (Vypravěč, Ibrahim, si není jistý co z toho.)


Zapamatovaná část Koránu

Vyprávěl Sahl bin Sad As-Sa'idi: Žena přišla k Aláhovu apoštolu a řekla: "Ó Aláhovu apoštole! Přišla jsem abych ti dala sebe k manželství (bez mahru)." Aláhův apoštol se na ni podíval. Podíval se na ni pořádně a hleděl na ni a poté sklopil hlavu. Když žena viděla, že nic neříkal, posadila se. Jeden z jeho společníků vstal a řekl: "Ó Aláhovu apoštole! Pokud ji nepotřebuješ tak ji provdej se mnou." 'Prorok řekl: "Máš něco k nabídnutí?"' Muž řekl "Ne, při Aláhu, ó Aláhově apoštole!" Prorok mu řekl: "Běž ke své rodině a podívej se jestli něco máš." Muž šel a vrátil se, říkajíc: "Ne, při Aláhu, nenašel jsem nic." Aláhův apoštol řekl: "(Bež znova) a najdi něco, i kdyby to byl železný prsten." Šel znova a přišel, říkajíc: "Ne, při Aláhu, ó Aláhovu apoštole! Nenašel jsem dokonce ani železný prsten, ale tohle je můj Izar (látka kolem pasu)." Neměl rida. Dodal: "Dám ji polovinu z toho." Aláhův apoštol řekl: "Co bude dělat s tvým Izarem? Pokud jej budeš nosit, ona bude nahá, a pokud jej bude nosit ona, ty budeš nahý." Tak si muž sedl na dlouhou dobu a poté vstal (k odchodu). Když jej Aláhův apoštol viděl jít, přikázal aby byl zavolán zpět. Když přišel, 'prorok řekl: "Kolik toho znáš z Koránu?"' On řekl: "Znám tu a tu súru" vyjmenovával je. Prorok řekl: "Znáš je zpaměti?" On odpověděl: "Ano." Prorok řekl: '"Běž, provdám tě s ní, za tu část Koránu, kterou znáš."'

Něco v hodnotě železného prstenu

Vyprávěl Sahl bin Sad: Prorok řekl muži: "Ožeň se třeba i s mahrem v hodnotě železného prstenu."

Zahrada nebo dvě

Vyprávěl Ibn 'Abbas: The wife of Thabit bin Qais came to the Prophet and said, "O Allah's Apostle! I do not blame Thabit for defects in his character or his religion, but I, being a Muslim, dislike to behave in un-Islamic manner (if I remain with him)." On that Allah's Apostle said (to her), '"Will you give back the garden which your husband has given you (as Mahr)?"' She said, "Yes." Then the Prophet said to Thabit, "O Thabit! Accept your garden, and divorce her once."
Narrated Aisha, Ummul Mu'minin: Habibah daughter of Sahl was the wife of Thabit ibn Qays Shimmas He beat her and broke some of her part. So she came to the Prophet (peace be upon him) after morning, and complained to him against her husband. The Prophet (peace be upon him) called on Thabit ibn Qays and said (to him): Take a part of her property and separate yourself from her. He asked: Is that right, Apostle of Allah? He said: Yes. He said: 'I have given her two gardens of mine as a dower', and they are already in her possession. The Prophet (peace be upon him) said: Take them and separate yourself from her.

Two handfuls of flour or dates

Narrated Jabir ibn Abdullah:

The Prophet (peace be upon him) said: If anyone gives as a dower to his wife two handfuls of flour or dates he has made her lawful for him.

AbuDawud said: This tradition has been narrated by AbdurRahman ibn Mahdi, from Salih ibn Ruman, from AbuzZubayr on the authority of Jabir as his own statement (not going back to the Prophet). It has also been transmitted by AbuAsim from Salih ibn Ruman , from AbuzZubayr on the authority of Jabir who said: During the lifetime of the Apostle of Allah (peace be upon him) we used to contract temporary marriage for a handful of grain.

The ahadith above present another problem for the mahr apologists. If it were true, that the mahr is an advance demonstration of a man's ability to financially support his wife, why then did Muhammad not mention this in any of the aforementioned narrations? Furthermore, in the narrations dealing with the Qur'an recitations, we see both Muhammad and the man in question knew that he had nothing material to give as a mahr. This clearly shows he was not financially stable and that the mahr in this case could not possibly have been a token of financial stability. This is why he had to resort to 'giving' his new bride his Qur'an memorizations. These narrations are a recount of a conversation Muhammad himself allegedly had. This means that Muhammad himself has confirmed that the apologist is wrong, and that the Mahr is simply given as payment for lawful sexual relations

Prohibitions regarding the mahr

Don't give excessive mahrs

Narrated Umar ibn al-Khattab: AbulAjfa' as-Sulami said: Umar (Allah be pleased with him) delivered a speech to us and said: Do not go to extremes in giving women their dower, for if it represented honor in this world and piety in Allah's sight, the one of you most entitled to do so would have been the Prophet (peace be upon him). The Apostle of Allah (peace be upon him) did not marry any of his wives or gave any of his daughters in marriage for more than twelve uqiyahs.

Don't take back the mahr

Divorce may be (pronounced) twice, then keep (them) in good fellowship or let (them) go with kindness; 'and it is not lawful for you to take any part of what you have given them', unless both fear that they cannot keep within the limits of Allah; then if you fear that they cannot keep within the limits of Allah, there is no blame on them for what she gives up to become free thereby. These are the limits of Allah, so do not exceed them and whoever exceeds the limits of Allah these it is that are the unjust.
Narrated Ibn Abbas: regarding the Divine Verse: "O you who believe! You are forbidden to inherit women against their will, and you should not treat them with harshness that you may take back part of the (Mahr) dower you have given them." (4.19) (Before this revelation) if a man died, his relatives used to have the right to inherit his wife, and one of them could marry her if he would, or they would give her in marriage if they wished, or, if they wished, they would not give her in marriage at all, and they would be more entitled to dispose her, than her own relatives. So the above Verse was revealed in this connection.
Narrated Said bin Jubair: I asked Ibn 'Umar, "(What is the verdict if) a man accuses his wife of illegal sexual intercourse?" Ibn 'Umar said, "The Prophet separated (by divorce) the couple of Bani Al-Ajlan, and said, (to them), 'Allah knows that one of you two is a liar; so will one of you repent?' But both of them refused. He again said, 'Allah knows that one of you two is a liar; so will one of you repent?' But both of them refused. So he separated them by divorce." (Aiyub, a sub-narrator said: 'Amr bin Dinar said to me, "There is something else in this Hadith which you have not mentioned. It goes thus: 'The man said, 'What about my money (i.e. the Mahr that I have given to my wife)?' It was said, 'You have no right to restore any money, for if you have spoken the truth (as regards the accusation), you have also consummated your marriage with her'; and if you have told a lie, you are less rightful to have your money back.' ")
Narrated Said bin Jubair: I asked Ibn 'Umar about those who were involved in a case of Lien. He said, "The Prophet said to those who were involved in a case of Lien, 'Your accounts are with Allah. One of you two is a liar, and you (the husband) have no right over her (she is divorced)." 'The man said, 'What about my property (Mahr) ?' The Prophet said, 'You have no right to get back your property. If you have told the truth about her then your property was for the consummation of your marriage with her'; and if you told a lie about her, then you are less rightful to get your property back.' " Sufyan, a sub-narrator said: I learned the Hadith from 'Amr. Narrated Aiyub: I heard Sa'id bin Jubair saying, "I asked Ibn 'Umar, 'If a man (accuses his wife for an illegal sexual intercourse and) carries out the process of Lian (what will happen)?' Ibn 'Umar set two of his fingers apart. (Sufyan set his index finger and middle finger apart.) Ibn 'Umar said, 'The Prophet separated the couple of Bani Al-Ajlan by divorce and said thrice, "Allah knows that one of you two is a liar; so will one of you repent (to Allah)?' "
Narrated Said bin Jubair: I said to Ibn 'Umar, "If a man accuses his wife of illegal sexual intercourse (what is the judgment)?" He said, "Allah's Prophet separated the couple of Bani 'Ajlan (when the husband accused his wife for an illegal sexual intercourse). The Prophet said, 'Allah knows that one of you two IS a liar; so will one of you repent?' But they refused. He then again said, 'Allah knows that one of you two is a liar; so will one of you repent?' But they refused, whereupon he separated them by divorce." Aiyub (a sub-narrator) said: 'Amr bin Dinar said to me, "In the narration there is something which I do not see you mentioning, i.e. 'the husband said, "What about my money (Mahr)?' The Prophet said, "You are not entitled to take back money, for if you told the truth you have already entered upon her (and consummated your marriage with her)' and if you are a liar then you are less entitled to take it back.
Sabra al-Juhanni reported on the authority of his father that while he was with Allah's Messenger (may peace be upon him) he said: 0 people, I had permitted you to contract temporary marriage with women, but Allah has forbidden it (now) until the Day of Resurrection. So he who has any (woman with this type of marriage contract) he should let her off, and do not take back anything you have given to then (as dower).
Sabra al-Juhanni reported on the authority of his father: Allah's Messenger (may peace be upon him) prohibited the contracting of temporary marriage and said: Behold, it is forbidden from this very day of yours to the Day of Resurrection, and he who has given something (as a dower) should not take it back.
Ibn Umar (Allah be pleased with them) reported Allah's Messenger (may peace be upon him) saying to the invokers of curse: Your account is with Allah. One of you must be a liar. You have now no right over this woman. He said: Messenger of Allah, what about my wealth (dower that I paid her at the time of marriage)? He said: You have no claim to wealth. If you tell the truth, it (dower) is the recompense for your having had the right to intercourse with her, and if you tell a lie against her, it is still more remote from you than she is. Zuhair said in his narration: Sufyan reported to us on the authority of 'Amr that he had heard Sa'id b Jubair saying: I heard Ibn Umar (Allah be pleased with them) saying that Allah's Messenger (may peace be upon him) had said it.

It cannot be said any clearly than that. You cannot take back the mahr that you have given to a wife, because you have already availed yourself of the service that it was a payment for (you have had sex with her).

Daughter trading in lieu of a mahr is not permissible

Narrated Ibn 'Umar : Allah's Apostle forbade Ash-Shighar, which means that somebody marries his daughter to somebody else, and the latter marries his daughter to the former without paying Mahr.
Narrated 'Abdullah: Nafi narrated to me that 'Abdullah said that Allah's Apostle forbade the Shighar. I asked Nafi', "What is the Shighar?" He said, "It is to marry the daughter of a man and marry one's daughter to that man (at the same time) without Mahr (in both cases); or to marry the sister of a man and marry one's own sister to that man without Mahr." Some people said, "If one, by a trick, marries on the basis of Shighar, the marriage is valid but its condition is illegal." The same scholar said regarding Al-Mut'a, "The marriage is invalid and its condition is illegal." Some others said, "The Mut'a and the Shighar are permissible but the condition is illegal."
Ibn Umar (Allah be pleased with them) said that Allah's Messenger (may peace be upon him) prohibited Shighar which means that a man gives his daughter in marriage on the condition that the other gives his daughter to him in marriage with- out any dower being paid by either.
Narrated Mu'awiyah: AbdurRahman ibn Hurmuz al-A'raj said: Al-Abbas ibn Abdullah ibn al-Abbas married his daughter to AbdurRahman ibn al-Hakam, and AbdurRahman married his daughter to him. And they made this (exchange) their dower. Mu'awiyah wrote to Marwan commanding him to separate them. He wrote in his letter: This is the shighar which the Apostle of Allah (peace be upon him) has forbidden.

This practice is forbidden because the service has not been paid for by the one using it. ie. the husband has not paid the wife for the sex he has had with her.

Exceptions regarding the mahr

Women who wish a divorce must return the mahr

Narrated Ibn 'Abbas: The wife of Thabit bin Qais came to the Prophet and said, "O Allah's Apostle! I do not blame Thabit for defects in his character or his religion, but I, being a Muslim, dislike to behave in un-Islamic manner (if I remain with him)." On that Allah's Apostle said (to her), "Will you give back the garden which your husband has given you (as Mahr)?" She said, "Yes." Then the Prophet said to Thabit, "O Thabit! Accept your garden, and divorce her once."
Narrated Aisha, Ummul Mu'minin: Habibah daughter of Sahl was the wife of Thabit ibn Qays Shimmas He beat her and broke some of her part. So she came to the Prophet (peace be upon him) after morning, and complained to him against her husband. The Prophet (peace be upon him) called on Thabit ibn Qays and said (to him): Take a part of her property and separate yourself from her. He asked: Is that right, Apostle of Allah? He said: Yes. He said: I have given her two gardens of mine as a dower, and they are already in her possession. The Prophet (peace be upon him) said: Take them and separate yourself from her.

Disbelieving wives shall return the mahr

O you who believe! when believing women come to you flying, then examine them; Allah knows best their faith; then if you find them to be believing women, do not send them back to the unbelievers, neither are these (women) lawful for them, nor are those (men) lawful for them, and give them what they have spent; and no blame attaches to you in marrying them when you give them their dowries; 'and hold not to the ties of marriage of unbelieving women, and ask for what you have spent', and ask them ask for what they have spent. That is Allah's judgment; He judges between you, and Allah is Knowing, Wise.

Wives may forfeit all or part of the mahr

And give women their dowries as a free gift, but if they of themselves be pleased to give up to you a portion of it, then eat it with enjoyment and with wholesome result.
And all married women except those whom your right hands possess (this is) Allah's ordinance to you, and lawful for you are (all women) besides those, provided that you seek (them) with your property, taking (them) in marriage not committing fornication. Then as to those whom you profit by, give them their dowries as appointed; and there is no blame on you about what you mutually agree after what is appointed; surely Allah is Knowing, Wise.

Divorce before consummation gives the wife half the agreed mahr

And if you divorce them before you have touched them and you have appointed for them a portion, then (pay to them) half of what you have appointed, unless they relinquish or he should relinquish in whose hand is the marriage tie; and it is nearer to righteousness that you should relinquish; and do not neglect the giving of free gifts between you; surely Allah sees what you do.

Závěr

Účel mahru popsaný islámskými texty je jasný. Je to platba od muže pro ženu. Je to platba v plné výši za budoucí sexuální vztahy (nikah) které s ní bude mít. To je znázorněno požadavkem mahru v dočasných "manželstvích", prohlášeních Mohameda, a faktem, že mahr nemůže být vzat zpět (leda při polehčujících okolnostech) protože muž využil službu za kterou platba byla. Apologetické tvrzení, že je to jen demonstrace jeho schopnosti finančně podpořit svou manželku neobstojí kritice, jakmile se podíváme na všechny důkazy. Dokonce i Korán jasně říká, že tak to není.
